Judges tosses suit against GOP

OMAHA, Neb. (AP) A former legislative candidate's lawsuit against the Nebraska Republican Party has been dismissed.

Douglas County District Judge Mark Ashford ruled that Rex Moats of Omaha failed to state a claim upon which relief may be granted.

Moats, a Democrat, lost the District 39 seat to Republican Beau McCoy in November. Legislative races are officially nonpartisan.

In mailings, the party questioned Moats' work with National Warranty Insurance Group. The vehicle-repair insurance company failed in 2003.

In his lawsuit, Moats said the mailings were "deliberate and unsubstantiated accusations intended to foment distrust or hatred."

A message left with Moats' attorney was not immediately returned.

The Republican Party says the lawsuit was meritless.
