Below are the contents of the letter attorney James Martin Davis addressed to Buster Brown, Omaha's city clerk, concerning a claim he was filing against the city on behalf of his client, Armondo Butler, who was shot early Sunday by an Omaha police officer:
Dear Mr. Brown,
Please be advised that I have been retained to represent Armondo Butler relating to the injuries he sustained on November 22, 2009. On that date, he was shot by an Omaha Police Officer, Calvin Harper, at or near the intersection of 40th and Farnam Streets, Omaha, Nebraska. This letter will serve as our Notice of a tort claim against the City of Omaha for the negligent, intentional and reckless acts of Officer Harper, and the violation of Armondo Butler's civil rights. I will be in further contact with the City once we have determined the full nature and extent of my client's injuries. Thank you for your consideration.
