Court says teacher wrongly fired

LINCOLN (AP) -- The Nebraska Supreme Court has upheld a lower court ruling that found a public school district wrongly fired a 23-year art teacher last year.

In a ruling issued Friday, the Supreme Court said Harvard Public Schools erred when it said a reduction in its work force necessitated Shari Miller's firing.

Court documents show the district eliminated its art program in 2008, but planned all along to share an art teacher with nearby Clay Center Public Schools. Because there was no reduction in programs, the high court says Miller should not have been terminated under Nebraska's teacher tenure law.

Miller's attorney, Scott Norby of Lincoln, says Miller plans to return to her teaching job.

An attorney for the school district did not immediately return a message seeking comment.
