Opponents of the State Fair's move to Grand Island made their final stand Tuesday, appearing before the Nebraska Supreme Court to argue that state law ordering the move was unconstitutional because it grants a special privilege to Grand Island.
Lincoln businessman Roger Yant has described the lawsuit as "Plan B," after a petition drive to change the law failed.
"There is no Plan C," he said following Tuesday's arguments.
State Fair officials already have moved their offices to Grand Island and construction of new fairgrounds is under way so the fair can open in August.
Legal title to the former state fairgrounds was transferred to the University of Nebraska-Lincoln in December, allowing the university to prepare for a planned public-private research park.
