WICHITA, Kan. (AP) — A Nebraska gas company has asked a court to confirm its right to condemn more than 9,100 acres in south-central Kansas to contain gas migrating from an underground storage facility.
Omaha-based Northern Natural Gas Co. filed the motion Thursday in U.S. District Court in Wichita. It seeks an order establishing its taking of property by eminent domain from unwilling sellers in Pratt, Kingman and Reno counties.
The move comes a week after the company filed a lawsuit targeting at least 173 property owners who some interest in 40 tracts of land.
In June, the Federal Energy Regulatory Commission granted Northern Natural Gas authority to expand its Cunningham Storage Field in Kansas by more than 12,000 acres. Thursday's motion seeks court confirmation of that decision.
