The family of an 11-year-old boy who drowned this summer at Lake Wanahoo filed a $1 million tort claim Wednesday against the Lower Platte North Natural Resources District.
Bayden Martinez-Rush of Wahoo, Neb., was fishing alone June 12 at Lake Wanahoo when he entered the dam spillway area, became stuck in a concrete drain and drowned. The claim filed, by Lincoln attorney Elizabeth Govaerts, alleges the district was negligent by failing to post warning signs near the spillway of the 662-acre lake about a mile north of Wahoo.
Govaerts, who represents Raul Martinez and Danelle Rush, said state law allows the NRD six months to respond to the claim. If no action is taken within six months, the claimants can file a lawsuit.
The next meeting of the NRD board is scheduled for Oct. 8. — Kevin Cole
