Investigators allege that a Bellevue couple repeatedly raped and sexually assaulted their 5-year-old son for a year.
The parents are being held without bail on charges of first-degree sexual assault and incest, both felonies.
Prosecutor Stephanie Hansen said the Sarpy County Attorney’s Office asked a judge to deny bail because of “the nature of the charges.”
Public Defender Tom Strigenz, who is representing the mother, said she maintains her innocence and plans to ask a judge to re-evaluate bail.
“We will be vigorously and aggressively pursuing vindication,” Strigenz said.
The father’s attorney, Ann Addison-Wageman, said in an email that the father looks forward to clearing his name. Addison-Wageman said the father’s “legal interests will be zealously advocated and that these are merely allegations which remain unproven.”
The investigation began in September, when the mother told her in-laws that she and her husband had sexually assaulted their 5-year-old, according to an arrest warrant.
The mother was angry after catching her husband with another woman, according to the warrant.
She said she participated in the assaults on her son in an attempt to save her marriage, the warrant states.
When the child was interviewed at Project Harmony, the boy said his mother had told him to tell investigators that he’d been sexually abused.
But his father promised to buy him a toy if he said it didn’t happen, the child said.
At the time, the child did not disclose any sexual abuse, according to the documents, and the mother recanted.
But an investigator noted that the mother “did not really have a good explanation as to why she would admit she had sexually abused” her son, according to the documents.
She was initially convicted of misdemeanor child abuse “for the alleged emotional abuse that she had put (the child) through.”
But officials found enough evidence of violence in the home and drug usage to have the boy removed from the home, according to court documents.
Prosecutors believe the real story came out Feb. 18, when the boy told a therapist that his parents had repeatedly raped and otherwise sexually assaulted him, according to documents.
He detailed the alleged abuse, saying it occurred with his father or both parents together — but never just his mother — in their bedroom, according to documents.
The two were charged last week.
In January, both parents pleaded no contest to assault by mutual consent for an October incident. Court documents say both engaged in “frequent verbal and physical domestic violence ... in the presence of the minor child.”
The father’s criminal record also includes a 1999 conviction for contributing to the delinquency of a child before his son was born.
They have a hearing scheduled March 18.
