Three 8-year-old boys were arrested after they allegedly tried to sexually assault a female classmate on the playground at Omaha's Belvedere Elementary School.
The boys pinned down the girl, removed her coat and unbuttoned her shirt, police said.
Two of the boys sat on the girl's arms, and the third sat on her stomach as he unbuttoned her shirt, said Brian Jorde, an attorney who has been retained by the girl's family.
The family is considering taking civil action against the Omaha Public Schools, he said.
The boys were arrested on suspicion of first-degree attempted sexual assault of the girl, who also is 8. The incident occurred Feb. 13.
Other Belvedere third-graders at recess saw the girl struggling and ran over to her, Jorde said. At that time, he said, the staff member on duty noticed a larger group of students and approached the group.
The boys and the girl were behind the playground equipment, Jorde said, initially out of sight of the staff member supervising about 50 children. Jorde said the girl suffered a bloody nose as she tried to get away from the boys.
Belvedere is at 3775 Curtis Ave. The girl has transferred to another school, Jorde said.
David Patton, OPS spokesman, declined to comment on the case, including whether the boys remain at Belvedere. Patton said he could not discuss student disciplinary cases.
Under Nebraska law, a person is guilty of first-degree sexual assault if he subjected another person to sexual penetration without consent; if the person knew or should have known that the victim was incapable of resisting; or if the alleged perpetrator is 19 or older and the victim is at least 12 but younger than 16.
