Douglas County Attorney Don Kleine said Tuesday that a man involved in the fatal shooting of Kevin F. McIntyre has been interviewed by Omaha police and released.
“Preliminarily, it appears the shooting was justified,” Kleine said. “But there is still an ongoing investigation. We are waiting on some testing to be done.”

McIntyre, 28, died Sunday shortly after being taken to the Nebraska Medical Center. His twin brother, Branden F. McIntyre, was treated at Creighton University Medical Center for a gunshot wound and released.
Both were shot at a party at 27th and Spencer Streets.
The shooter, whom Kleine declined to identify, turned himself in at Central Police Headquarters on Sunday. That person and other witnesses were interviewed by officers.
Kleine said the shooter had a registered firearm in his possession, but the gun was not owned by him. Police said the man was in legal possession of the weapon.
