NORTH PLATTE, Neb. — A rape case against a North Platte man was dismissed Tuesday.
Lincoln County District Judge Donald Rowlands dismissed a first-degree sexual assault case against Joshua Walsh, 20, of North Platte.
In the judge’s notes, Rowlands wrote that there was not enough probable cause to show that the alleged victim was subjected to sexual penetration.
“This is a weak circumstantial case, at best, and the fact that the alleged victim gave inconsistent statements to law enforcement on several key issues damages her credibility,” Rowlands wrote.
Walsh was charged in connection with an October 2012 incident at a North Platte home.
Walsh’s attorney, Robert Lindemeier, said DNA evidence was not conclusive enough to identify Walsh as the assailant. Lindemeier said that Walsh admitted being at the home when the alleged incident occurred, but that he had slept on a couch.
Walsh was released Tuesday after 91 days in the Lincoln County Detention Center.
