A federal judge has dismissed a lawsuit filed by accused killer Anthony J. Garcia, saying Garcia didn't pay a filing fee by the court's deadline.
In December, Garcia filed a $20 million lawsuit against the State of Nebraska, a Douglas County judge and two Omaha police officers, saying they were negligent and committed perjury in connection with the issuance of an arrest warrant for Garcia.
Garcia was arrested in July as a suspect in the 2008 slayings of Thomas Hunter and Shirlee Sherman and the May 2013 deaths of Roger and Mary Brumback. He has been charged with four counts of first-degree murder.
Senior U.S. District Judge Richard Kopf said Garcia didn't pay the initial, partial fee or ask for additional time to pay the fee by the Jan. 20 deadline. Kopf dismissed Garcia's case for failing to comply with a court order to pay the partial fee.
