Croker, Huck, Kasher, DeWitt, Anderson & Gonderinger, L.L.C. 2120 South 72nd Street, Suite 1200 Omaha, Nebraska 68124 SANITARY AND IMPROVEMENT DISTRICT NO. 335 OF SARPY COUNTY, NEBRASKA NOTICE NOTICE IS HEREBY GIVEN that a meeting of the Board of Trustees of Sanitary and Improvement District No. 335 of Sarpy County, Nebraska, will be held at 10208 South 168th Avenue, Omaha, Nebraska at 12:30 p.m. on September 21, 2020, which meeting will be open to the public. The agenda for such meeting, kept continuously current, is available for public inspection at the principal office of the Board of Trustees at 2120 South 72 Street, Suite 1200, Omaha, Nebraska, which agenda includes payment of bills of the District, and the consideration and passing (or amending and passing) of the following resolutions, to-wit: WATER QUALITY BASIN ACQUISITION BE IT RESOLVED that the Board of Trustees of Sanitary and Improvement District No. 335 of Sarpy County, Nebraska, find and determine that it is advisable and necessary for the District, pursuant to Section XIV, Paragraph D of the Lakeview Subdivision Agreement, entered into with the GretnaLake, LLC and City of Gretna, Nebraska, to acquire certain real property from GretnaLake, LLC, the Developer, for the development of water quality basins located within the boundaries of the District, the legal description of the real property to be acquired for such water quality basins being as follows: Outlots B, F and I, Lakeview, a subdivision in Sarpy County, Nebraska, as surveyed, platted and recorded. LIFT STATION LAND ACQUISITION BE IT RESOLVED that the Board of Trustees of Sanitary and Improvement District No. 335 of Sarpy County, Nebraska, find and determine that it is advisable and necessary for the District, pursuant to Section XIV, Paragraph E of the Lakeview Subdivision Agreement, entered into with the GretnaLake, LLC and City of Gretna, Nebraska, to acquire certain real property from GretnaLake, LLC, the Developer, for the development of a lift station located within the boundaries of the District, the legal description of the real property to be acquired for such lift station being as follows: Outlot H, Lakeview, a subdivision in Sarpy County, Nebraska, as surveyed, platted and recorded. All lots and streets referred to are those shown on the plat of Lakeview, a subdivision in Sarpy County, Nebraska, a copy of which plat is on file with the County of Sarpy, Nebraska. The plans and specifications for Water Qualify Basin Acquisition and Lift Station Land Acquisition have been reviewed by Lamp Rynearson, Inc., engineers for the District, and said engineers have filed with the District prior to the first publication of this resolution an estimate of the total costs for proposed improvements, including engineering supervision, publication, legal and miscellaneous costs, in the following sums: Water Quality Basin Acquisition -$141,703.74; Lift Station Land Acquisition - $39,835.27 To pay the cost of said acquisition and park improvements, the Board of Trustees shall have the power to issue negotiable bonds after such improvements have been completed and accepted; said bonds to be called "Sanitary and Improvement District Bonds" and to be payable and bear interest as provided by the Statutes of Nebraska. The Board of Trustees shall have the power to assess, to the extent of special benefits, the cost of such portions of said improvements as are local improvements, against properties found specially benefitted thereby. All special assessments which may be levied upon property specially benefitted by such improvements shall, when collected, be set aside and constitute a sinking fund for the payment of the interest and principal of said bonds. The District shall also cause to be levied annually a tax upon the assessed value of all the taxable property in the District, except intangible property, which together with said sinking fund derived from special assessments, shall be sufficient to meet payments of interest and principal of said bonds as they become due; said tax shall be known as the Sanitary and Improvement District Tax, and shall be payable annually in money. Any owner of property which might become subject to assessment for the contemplated improvements may appear and make objections to the proposed improvements. This proposed resolution may be amended and passed or may be passed as proposed. If a petition opposing the resolution, signed by property owners representing a majority of the front footage which may become subject to assessment for the cost of said improvements, be filed with the Clerk of the District within three days before the date of the meeting for the hearing on said resolution, such resolution shall not be passed. The outer boundaries of the area in the District in which it is proposed to make special assessments for said improvements are the outer boundaries of said Sanitary and Improvement District No. 335 of Sarpy County, Nebraska.
