Croker Huck Law Firm 2120 South 72nd Street, Suite 1200 Omaha, Nebraska 68124 SANITARY AND IMPROVEMENT DISTRICT NO. 278 OF SARPY COUNTY, NEBRASKA NOTICE NOTICE IS HEREBY GIVEN that a meeting of the Board of Trustees of Sanitary and Improvement District No. 278 of Sarpy County, Nebraska, will be held at 10208 South 168th Avenue, Omaha, Sarpy County, Nebraska, at 11:00 a.m. on August 3, 2021, which meeting will be open to the public. The agenda for such meeting, kept continuously current, is available for public inspection at the principal office of the Board of Trustees at 2120 South 72nd Street, Suite 1200, Omaha, Nebraska; which agenda includes payment of bills of the District, and the consideration and passing (or amending and passing) of the following resolutions, to-wit: SUBDIVISION AGREEMENT Tiburon Ridge North Subdivision Agreement and Plan Review Fees BE IT RESOLVED that the Board of Trustees of Sanitary and Improvement District No. 278 of Sarpy County, Nebraska ("District"), find and determine that was advisable and necessary for the District to enter into a Subdivision Agreement with the County of Sarpy, Nebraska ("County") and JMF, LLC ("Developer") in connection with the development and improvement of an area in the District identified as Lots 1 through 42, inclusive, and Outlot A, Tiburon Ridge North, a subdivision in Sarpy County, Nebraska. BE IT FURTHER RESOLVED that said Subdivision Agreement shall provide for the manner and extent to which public funds will be expended to construct necessary public improvements to serve said Tiburon Ridge North, a subdivision owned by JMF, LLC, which said subdivision is located within the boundaries of the District and within the County's zoning and platting jurisdiction, and to connect to the sewer system of Sarpy County and the City of Gretna; and said Subdivision Agreement shall further declare the extent to which said public improvements specially benefit property in Tiburon Ridge North and to what extent the cost of same shall be specially assessed. BE IT FURTHER RESOLVED that said Subdivision Agreement shall require District to pay to County a fee in the amount of $6,139.82 to cover engineering, legal and other miscellaneous expenses incurred by County in connection with any necessary review of plans and specifications in connection with the construction projects performed by District. BE IT FURTHER RESOLVED that said fees shall be paid by issuance and delivery of warrants of the District in said amounts, bearing interest at the rate set by the Board of Trustees. All lots and streets referred to are those shown on the plat of Tiburon Ridge North, a subdivision in Sarpy County, Nebraska, a copy of which plat is on file with the County of Sarpy, Nebraska. The Subdivision Agreement has been reviewed by Lamp Rynearson, Inc., engineers for the District, and said engineers have filed with the District prior to the first publication of this resolution, an estimate of the total costs of the fees, including engineering supervision, publication, legal, interest and miscellaneous costs, in the following sum: Plan Review Fee - $6,868.00 To pay the cost of said fees and improvements, the Board of Trustees shall have the power to issue negotiable bonds after such improvements have been completed and accepted; said bonds to be called "Sanitary and Improvement District Bonds" and to be payable and bear interest as provided by the Statutes of Nebraska. The Board of Trustees shall have the power to assess, to the extent of special benefits, the cost of such portions of said improvements as are local improvements, against properties found especially benefited thereby. All special assessments which may be levied upon properties specially benefited by such improvements shall, when collected, be set aside and constitute a sinking fund for the payment of the interest and principal of said bonds. The District shall also cause to be levied annually a tax upon the assessed value of all the taxable property in the District, except intangible property, which, together with said sinking fund derived from special assessments, shall be sufficient to meet payments of interest and principal of said bonds as the same become due; said tax shall be known as the Sanitary and Improvement District Tax, and shall be payable annually in money. Any owner of property which might become subject to assessment for the contemplated improvements may appear and make objections to the proposed improvements. This proposed resolution may be amended and passed or may be passed as proposed. If a petition opposing the resolution, signed by property owners representing a majority of the front footage which may become subject to assessment for the cost of said improvements be filed with the Clerk of the District within three days before the date of the meeting for the hearing on said resolution, such resolution shall not be passed. The outer boundaries of the area in which it is proposed to make special assessments for said improvements are the same as the outer boundaries of SID 278 of Sarpy County, Nebraska.
