Man gets 35 to 45 years in prison for sex assault of Nebraska teen

LINCOLN — A 39-year-old man already serving time in a California prison for sexual abuse of a minor has been sentenced to 35 to 45 years in a Nebraska prison for a similar teen sex crime committed years earlier.

Todd Tackwell said this week that he broke Nebraska law when he conducted what he described as a consensual relationship starting in 2004 with a girl who was then 14, the Lincoln Journal Star reported.

Under Nebraska law, people 19 and over cannot have sexual contact with people under 16.

“This happens all the time in history. How can all of a sudden it be wrong?” Tackwell said in court at his sentencing. “It can't be wrong. It is the position of the Legislature of Nebraska to say we're going to make a law about it. I don't have to agree with that.”

In September, Tackwell pleaded no contest to sexual assault of a minor. Authorities said Tackwell rented the basement of the Lincoln house where the girl lived.

The victim told the newspaper after the sentencing that she broke off the relationship in 2006. She said she didn't know how to handle the situation, so she told her mother only that she and Tackwell had kissed. Her mother threw him out.

The Associated Press is not using the woman's name because she is a victim of sexual assault.

In 2010 she learned that Tackwell had been arrested in Pleasanton, Calif., accused of continuous sexual abuse of a 13-year-old. That's when the Nebraska woman realized that Tackwell needed to be kept from harming anyone else, so she stepped forward.

He was convicted on April 24, 2012, and has been serving his sentence of 25 years to life in San Quentin Prison. His Nebraska time is to be served if he's ever released from California custody.
